3. Counter-Notification Procedures

4. DMCA Process Timeline

Day 0:    Valid DMCA complaint received
Day 1-3:  Content reviewed and removed/access disabled
Day 1-3:  User who posted content notified of removal
Day 10+:  If counter-notification received, content may be restored
Day 10-14: Complainant notified of counter-notification
Day 14+:  Unless court action filed, content restored

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, New School Georgia has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Definition of Repeat Infringer:
A user who has received three (3) or more valid DMCA takedown notices within a 12-month period.

6. Good Faith Requirement

For Complainants:

  • The DMCA requires that you make a good faith determination that the use is not authorized
  • Knowingly misrepresenting that material is infringing may expose you to liability for damages (including costs and attorneys’ fees)
